Terms of Service (AGB)

§ 1 Scope

These General Terms and Conditions (hereinafter "Terms") apply to all future contracts between RMR Dynamics(hereinafter "Provider"), owner Florian Römer, Ulberndorfer Weg 9, 01277 Dresden, and the customer regarding the use of the digital services provided by the Provider (hereinafter "Services"). Conflicting terms of the customer are expressly not recognised.

These Terms do not take effect until a paid offering is made available. No paid services are currently offered via this website.

§ 2 Conclusion of contract

The display of services on this website — where paid offerings are published — constitutes an invitation to submit an offer. By selecting a service in the checkout and clicking the button "Confirm paid subscription", the customer submits a binding offer to conclude a contract. The contract is concluded by the Provider's confirmation by email (order confirmation). The contract language is English.

§ 3 Provider's services

The subject of the services is access to the digital tools designated in the respective contract, according to the scope of functionality valid at the start of the contract. The Provider reserves the right to further develop, change, or extend functions, provided this does not materially restrict the core scope of services contractually agreed.

§ 4 Prices, due date, and price indication

The prices displayed in the checkout at the time the contract is concluded shall apply. Prices for consumers are inclusive of applicable value-added tax. For business customers, VAT is shown as reverse charge under § 13b of the German VAT Act (UStG) where and to the extent required by the place of supply. The fee becomes due in the agreed billing interval.

§ 5 Billing interval and automatic renewal

The subscription is concluded for the selected term (e.g. monthly or annual). It automatically renews for a further interval of the same type unless the customer cancels by the end of the current term.

§ 6 Cancellation

Cancellation may be made informally by email to contact@rmr-dynamics.com. The notice period for monthly subscriptions is 14 days to the end of the billing month; for annual subscriptions it is one month to the end of the annual term. The statutory right of withdrawal for consumers under § 355 of the German Civil Code (BGB) remains unaffected.

§ 7 Customer obligations

The customer assures that the data provided at registration is correct and complete. Compliance with the usage terms of any third-party providers used (e.g. AI models, providers) is the customer's responsibility.

§ 8 Availability

The Provider aims to ensure a high level of availability of the services. Maintenance work, third-party disruptions, and force majeure remain reserved.

§ 9 Limitation of liability

The Provider is liable without limitation for intent and gross negligence, and under the German Product Liability Act. For slight negligence, the Provider is liable only for breach of an essential contractual duty and only up to the amount of the typically foreseeable damage.

§ 10 Final provisions

The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Where the customer is a consumer, mandatory consumer-protection provisions of the state in which the consumer has their habitual residence remain unaffected. Place of performance and — insofar as legally permissible — place of jurisdiction is Dresden.
